Federal lawsuit claims common fridge failures are corporate fraud
More than 100 people are making a federal case out of their refrigerator troubles. They’re suing over fridges that they say failed far faster than they ever expected. What is the difference between a lawsuit and a tort claim?
A lawsuit is a formal case that has been filed in the appropriate court of law, while a tort claim is usually an informal notice of claim that may trigger an informal resolution without the cost of litigation. Depending on the type of accident or injury, an experienced attorney may resolve claims without the need to initiate a formal lawsuit. For example, most automobile accident claims are resolved prior to a lawsuit by contacting and negotiating with the at-fault driver’s insurance company.
In other circumstances, a tort claim is a necessary first step before filing a lawsuit. For example, suing a government agency will almost always require submitting an informal tort claim first. In California, a person must submit a tort claim within six months in order to preserve their right to sue ...

More than 100 people are making a federal case out of their refrigerator troubles. They’re suing over fridges that they say failed far faster than they ever expected. Chris Chmura and the NBC Bay Area Responds team recently looked into the issue -- including one Redwood City woman who’s had three new fridges in just five years.
A Los Angeles law firm is leading the case and is aiming to make it a class action lawsuit. The lead attorney says there are possibly “tens of thousands” of consumers whose LG and Kenmore refrigerators died earlier than they should have.
At the core of the federal complaint is a component at the core of many refrigerators: a linear compressor. It’s what keeps the food cold. LG makes it and advertises the linear compressor with a 10-year warranty. Online, LG literature states “20-year durability.”
But the lawsuit claims the compressors are failing far earlier than 10 years in both LG and Kenmore models (Kenmore used an LG compressor). The plaintiffs argue LG, Kenmore, and several large chain stores were aware of the issue. Those consumers say the companies defrauded them when they bought LG or Kenmore models, some of which cost more than $2,000.
LG told NBC Los Angeles that it doesn’t comment on pending litigation. Kenmore said it no longer uses a LG compressor.
People who bought an LG or Kenmore refrigerator after January 1, 2018 might be able to join the lawsuit. You can learn more about the case by contacting the law firm: http://bhtrialattorneys.com
Christine Roher at NBC Los Angeles contributed to this story.

UPDATE: Our team recently looked into the latest twist in the case. LG is arguing that owners can’t sue. Instead, LG wants to force owners to go to arbitration. And part of the company’s argument hinges on people’s refrigerator boxes.

Indochino makes fully custom suits that fit perfectly using any material I want, with all of the options I want. And they cost 1/3rd of what normal suits costs. I’ve purchased them with my own money for years, so I’m thrilled they are now a sponsor.
▶ Why Ties from TheTieBar? (Free shipping on orders over $50) [https://fave.co/2ImLY9I]: Normal ties are too fat. Skinny ties are too skinny. So these days I only wear ties that are exactly 2.5” wide. They are fashionable without being hipster. You see them in all of my videos. ▶ Why these Tie Clips? [https://amzn.to/2WIQ6EE]: It’s really hard to find affordable tie clips that are the right size (1.5”), look good, and are great quality. These tie bars are all three. Plus the 3-pack gives a variety of styles. They pair perfectly with 2.5” ties from TheTieBar (above).
▶ Why these Pocket Squares? [https://amzn.to/2UfsKtL]: I like my pocket squares perfectly, well, square. Like straight-out-of-Mad-Men square. The only way to do that is with a stiffer material that keeps its shape. I’ve exhaustively tried dozens of pocket squares, and these are by far the best. It’s how I get the perfectly flat pocket square you see in my videos.

In California, a person must submit a tort claim within six months in order to preserve their right to sue a government agency – even if their claims are based on a car accident rather than, say, a civil rights claim. Claims against federal employees or agencies also require timely compliance with the Federal Tort Claims Act (“FTCA”) in order to proceed with a lawsuit.
In order to better understand whether a tort claim is appropriate or necessary in your case, it is important that you consult with an experienced civil litigation attorney right away. There may be deadlines or procedural requirements that need to be handled at the outset of your case to make sure that your rights are protected.

The basic components of a lawsuit are referred to as "elements." What does that "elements" mean? Well, im going to break it down for you and show you how this applies to child support.
In this video, we're going to explain the procedures and processes and give you a few examples from a cases that can be used as references. I'm going to be talking about the issue of absolute immunity and qualified immunity.
The concept of judicial immunity protection is something that is frequently misunderstood. Absolute and qualified immunity are two different judicial protection that are often used by judges to defend civil prosecution for unlawful acts committed in the course of official duties.

A new lawsuit alleges a Meigs County deputy was not 'properly trained' before a deadly crash into the Tennessee river that killed him and a woman he arrested.
The lawsuit was filed on behalf of that woman, Tabitha Smith.
Tabitha Smith and Deputy RJ Leonard went missing on February 14th after the deputy arrested her late that night.
The next day, law enforcement discovered that Deputy Leonard had driven off a boat ramp into the Tennessee river.
